To get a cannabis license in Trinity County, a business must first obtain local approval under Trinity County’s commercial cannabis ordinance and then obtain a state license from the Department of Cannabis Control (DCC). In unincorporated Trinity County, the county’s cannabis division sets zoning, CEQA, and operating rules for activities such as cultivation, processing, manufacturing, and distribution, and an operator must secure the appropriate Trinity County commercial cannabis permit for the specific parcel and license type. After the county issues that local permit, the operator can apply to DCC for the corresponding state cannabis license, using the county approval, premises diagram, and environmental documentation to complete the state application.
To get a cannabis growers license in Trinity County, a cultivator must first qualify for a local cultivation permit and then obtain a state cultivation license from the Department of Cannabis Control (DCC). Trinity County’s cannabis ordinance governs where commercial cannabis cultivation is allowed, what parcel sizes and setbacks are required, and what environmental and operating conditions must be met before the county will approve a grow site. Once the cultivator has obtained a Trinity County cultivation permit for a specific parcel and satisfied all zoning, environmental, and operating requirements, the cultivator submits a DCC cultivation application with detailed premises diagrams, water and environmental disclosures, CEQA documentation, and proof of Trinity County’s authorization for the grow.
Because Trinity County has restricted or prohibited industrial hemp cultivation through its moratorium and proposed permanent ban, there is no active process or timeline for obtaining a hemp grow authorization in Trinity County. Producers interested in hemp cultivation typically apply instead in other California counties where the agricultural commissioner accepts CDFA industrial hemp registrations.
Trinity County has a moratorium on industrial hemp cultivation and is moving toward a permanent hemp ban, so there is no current hemp grower registration cost specific to Trinity County. If Trinity County ever allowed industrial hemp, a grower would pay at least the statewide $900 annual CDFA registration fee per county plus any local fees the Trinity County Agricultural Commissioner adopted.
